Vice President is elected today, how is this election, who can vote, know the whole process

Vice Presidential Election: The country is going to get a new Vice President today. Voting for the Vice Presidential Election 2022 will be held in the Parliament House from 10 am to 5 pm today. The votes will be counted immediately thereafter. By late evening, the Returning Officers will announce the name of the new Vice President of the country.

This time the contest is between National Democratic Alliance (NDA) candidate Jagdeep Dhankhar and opposition joint candidate Margaret Alva. In terms of statistics, the victory of former West Bengal Governor Dhankhar seems certain. We tell you how the Vice President is elected, who votes in it, how the votes are counted.

What does the constitution say about the Vice President?,

• Article 63 states that “there shall be a Vice-President of India”.
• According to Article 64, the Vice-President “shall be the ex-officio President of the Council of States”.
• According to Article 65, “In the event of the death, resignation or removal of the President, the Vice-President shall act as President until the date on which a new President is appointed.”

when is the election,

• According to the constitution, elections have to be held within 60 days of the completion of the term of the Vice President.
• For the election of the Vice President, the Election Commission appoints an Returning Officer.
• This Returning Officer is the Secretary General of either House.
• The Returning Officer issues a public note regarding the election and calls for nominations from the candidates.

Who? Can you vote?

• The President and the Vice President are important constitutional posts.
• The election of both the posts is done indirectly. That is, the election is done by the people’s representatives elected by them instead of the people.
• Only MPs can vote in the Vice Presidential election. At the same time, the members of the state legislatures also have the right to vote in the election of the President.
• Nominated members of Rajya Sabha and Lok Sabha can also vote in the election of the Vice-President. Whereas the President cannot vote for the nominated member of any house in the election.

This is the process of choosing the Vice President

• To file nomination for the post of Vice President, a candidate has to fulfill the condition of showing at least 20 MPs as proposers and 20 MPs as supporters.
• The candidate should not be a member of either House of the Parliament.
• If an MP wants to contest the election, he has to resign from the membership of the Parliament.

proportional representation system

• The Vice-President is elected through the system of proportional representation through an electoral college consisting of members of both the Houses of Parliament.
• Each member of parliament can cast only one vote.
• The voter has to decide the priority on the basis of his choice.
• In the list of candidates present on the ballot paper during the voting, the voter gives priority to his first choice 1, second choice to 2 and so on.
• Elected members (233) and nominated members (12) of Rajya Sabha, while elected members of Lok Sabha (543) and nominated members (2) take a total of 790 electors of both the houses.

special way of counting

• In the counting, it is first seen how many votes have been received by all the candidates with the first priority.
• The first priority votes received by the candidates are added up. After this the total number is divided by 2 and 1 is added to the quotient.
• The number obtained after this is considered as the quota, which is required by a candidate to remain in the counting.
• If a candidate secures votes equal to or more than the quota required for victory in the first counting, then that candidate is declared to have won.
• If the result is not available then this process is carried forward. Then the candidate with the lowest number of votes is thrown out of the race. But in the votes that give him the first priority, it is seen that who has been given second priority in voting. After this, these second priority votes are transferred to the account of other candidates.
• After the transfer of these votes, if the votes of a candidate are equal to or more than the quota number, then that candidate is declared the winner.
• This process continues till one candidate gets votes equal to the quota.

According to Article-71 of the Constitution, only the Supreme Court of the country has the right to decide if any doubt or dispute arises in the election of President or Vice President.
