Hearing was held on July 20

Earlier in the hearing held on July 20, the court had indicated that a constitution bench could be constituted to hear the matter. On that day, the court had asked all the parties to talk among themselves and submit a compilation of the points of hearing. Let us inform that many petitions of leaders of both the factions are pending in the Supreme Court and in these petitions many issues like disqualification of MLAs, invitation to Shinde faction on behalf of Governor, issue of two whips of Shiv Sena in trust vote have been raised.

Both the Shinde-Uddhav factions have put forth their demands.

The Uddhav Thackeray faction has also filed a new petition demanding that the Supreme Court stay the process going on in the Election Commission to allot Shiv Sena’s election symbol. In another petition of Uddhav Camp, the action of the Lok Sabha Speaker has also been challenged. So at the same time, in this petition, there has been opposition to the recognition of Shinde party MP Rahul Shewale as the leader of the party in the Lok Sabha and Bhavna Gawale as the Chief Whip.

In the last hearing, the court had given instructions

In the last hearing, the Supreme Court had directed to maintain status quo on issues like disqualification of MLAs. At the same time, it was also said that all the records of the assembly related to the matter should be kept safe. Today the court can decide whether to refer it to a 5-judge Constitution Bench due to the constitutional questions being raised in the matter. In such a situation, the court can also decide the framework of further hearing. If any interim relief is sought from either side, then a 3-judge bench can also consider it.
