PIL in Delhi High Court: A Public Interest Litigation (PIL) has been filed in the Delhi High Court seeking a ban on forced conversion. In this public interest litigation, it has been sought to give appropriate directions to the Central and Delhi Government to stop the forced conversion through intimidation and black magic and superstition. It has been said in the petition that religious conversion in any way violates Articles 14, 15, 21, 25.
In the PIL filed in the Delhi High Court, conversion has also been said to be against the principles of secularism, which is an integral part of the basic structure of the Constitution.
Public interest litigation to stop religious conversion
Petitioner Ashwini Kumar Upadhyay, who has given a public interest litigation in the Delhi High Court, is also a lawyer and BJP leader by profession. The petitioner says that the Center and the Delhi government have failed to control the menace of black magic, superstition and conversion by fraud. It is their duty under Article 51A and demands to issue directions to the Centre. It is a matter of appointing a committee to suggest changes in Chapter XV of the Indian Penal Code or to draft a religious conversion act.
Is conversion happening due to black magic?
It has been said in the petition that there is not a single district which is free from black magic, superstition and religious conversion. Incidents of mass conversions are coming to the fore every day. The work of conversion is going on through intimidation, deception, through gifts and economic benefits and through black magic, superstition.
What was said in the PIL?
In the PIL filed by Ashwini Kumar Upadhyay in the Delhi High Court, it has also been said that the Center and the state have the right to make special provisions for the benefit of women and children. The Constitution seeks to promote equality of opportunity and fraternity among them, to ensure the dignity, unity and integrity of individuals, but the Center and the State have taken appropriate steps to secure the high ideals set forth in the Preamble and Part-III. steps have not been taken.
